What the ATO Considers
The ATO’s current criteria for early release on compassionate grounds include:
- The surgery is required to treat a chronic or acute medical condition.
- There is no other reasonable way for you to pay for the procedure.
- The surgery has not yet been paid for (applications must be made before your procedure).
- The claim is for you or a dependent (such as a spouse or child).
- The surgery is not readily available through the public health system.

Preparing Your Application
Before starting your application, it’s worth checking whether your super fund allows early release for surgery. If your current fund does not, you may be able to transfer your balance to another fund that permits release under compassionate grounds.
To prepare:
- Understand the procedure and costs – Review the surgery information and associated fees on our website.
- See your GP for a referral – This helps support your medical case.
- Book a consultation at BB Clinic – We will provide a medical assessment, confirm whether the procedure meets the ATO’s medical criteria, and prepare the required specialist documentation.
- Gather the required paperwork:
- Itemised surgical quote.
- Completed Early Release of Super form from your GP.
- Completed Early Release of Super form from your BB Clinic surgeon.
We charge a small administration fee for preparing and submitting these documents, which is adjusted toward your surgery cost should you proceed.
Once your paperwork is ready, you can submit your application via the ATO’s MyGov portal.
